Codes of practice

Latest codes

The latest codes of practice came into force on 1 February 2008.  Available in full here.

 

Apply to all police powers

The codes apply to all powers - in addition to sec1 PACE - with only three minor exceptions.
 

Code of practice A

Deals with the exercise by police officers of statutory powers to search a person or a vehicle without first making an arrest.

 

It also deals with the need for a police officer to make a record of a stop or encounter.

 

Code A provides guidance to the police and public on the limits of Stop and Search powers found in  Section 1 Police and Criminal Evidence Act 1984.
 

Code of practice B

Deals with police powers to search premises and to seize and retain property found on premises and persons.

 

Code of practice C

The revised code of practice in connection with the detention, treatment and questioning of persons by police officers (Code C) laid before Parliament came into operation on 25th July 2006. (not related to terrorism).

 

Code of practice D

Concerns the main methods used by the police to identify people in connection with the investigation of offences and the keeping of accurate and reliable criminal records.

 

Code of practice E

Deals with the tape recording of interviews with suspects in the police station.

 

Code of practice F

Deals with the visual recording with sound of interviews with suspects. There is no statutory requirement on police officers to visually record interviews. However, the contents of this code should be considered if an interviewing officer decides to make a visual recording with sound of an interview with a suspect.

 

Code of practice G

Deals with powers of arrest under section 24 the Police and Criminal Evidence Act 1984 as amended by section 110 of the Serious Organised Crime and Police Act 2005.

 

Code of practice H

The code of practice in connection with the detention, treatment and questioning by police officers of persons under section 41 of, and Schedule 8 to, the Terrorism Act 2000 (Code H) laid before Parliament came into operation on 25th July 2006.

Criminal Defence Service Direct (CDS Direct)

Implementation of recommendations that flow from the Carter Review into the provision of publicly funded legal advice through the expansion of Criminal Defence Service Direct (CDS Direct).

 

The service provides duty solicitor advice by telephone for relatively straightforward offences such as drink driving, disorderly behaviour or minor assaults.

 

The changes extend telephone advice to these categories of cases where the detainee asks for publicly funded legal advice from their own solicitor.

 

Police photographing not at station

Reflects changes made by the Violent Crime Reduction Act 2006 enabling the police to take a photograph elsewhere than at a police station of a person given a direction to leave and not return to a specified location.

 

Stop and search - firearms

Code A, clarifies that the definition of "offensive weapon" under section 1 of PACE (Stop and Search) includes firearms.
